AUTHENTICATION

Document to-be-authenticated by this Consulate must first be authenticated by the Victoria Office or Tasmania Office of Australian Department of Foreign Affairs and Trade (Hereafter referred to as DFAT).

Requirements for authentication application are: one completed application form; the original document (already authenticated by DFAT) and its photocopy; the applicant's ID and its photocopy.

Governmental document which is to be used inChina, like "No Record Result", "Certificate of Divorce", can be directly sent to DFAT for authentication. Non-governmental document, like Power of Attorney,

Statutory Declaration, must first be certified by Notary Public, then can be authenticated by DFAT and finally authenticated by this Consulate.

Documents over two leaves must be formally sealed before they are handed in to this Consulate.

****Getting married in China****

If you are never-married, you are only requested to present your

DFAT-authenticated "No Record "Result and its photocopy;

If you divorced inAustralia, besides the "No Record" Result, you

are also requested to present your DFAT-authenticated Decree Nisi ;

If your ex-spouse died inAustralia, please also present the DFAT-authenticated Death Certificate.

According to Chinese Law, when a divorced alien applies for marriage inChina, if his or her ex-spouse is Chinese citizen, their Decree Nisi must be judged and accepted by People's Court of China.

To prove your ex-spouse's nationality, you may present one of the following DFAT-authenticated documents:

1)Divorce certificate on which both parties' nationality are mentioned;

2)Marriage Certificate on which both parties' nationality are mentioned;

3)Citizenship Certificate;

4)Notarized photocopy of your ex-spouse's passport;

5)Notarized "Ex-spouse Nationality Statement" made by you;

6)Notarized "Nationality Statement" made by your ex-spouse.

* The "No Record" Result authenticated by DFAT must be sent to the Consulate for authentication within 3 months. And the Consulate-authenticated one can only be used inChinawithin 6months.
